Evaluation of a Regulatory Program

Client: SafeWork NSW

RELATED SERVICES

Changes to the legislation from 2012 enabled SafeWork NSW to offer enforceable undertakings (EUs) as an alternative to prosecution for businesses that had allegedly serious breaches of work health and safety laws, resulting in serious injury or fatality. The organisation had built up a sufficient caseload of EUs and commissioned Nexus to determine the extent to which the program had been achieving its intended outcomes of securing significant work health and safety outcomes at the individual workplace, industry-wide and broader community levels.

The evaluation was a multi-method approach, involving analysis of SafeWork NSW data and surveys and consultations with businesses that had entered into EUs.

The evaluation concluded that, in general, businesses met their obligations under the EU and delivered significant workplace health and safety outcomes, often over a number of years. EUs were seen to achieve systemic and workplace culture change because they required sustained commitment over a number of years, at considerable expense to the companies involved.
